What is an Unregulated Donor?

An unregulated donor is someone you do not have a genuine, pre-existing relationship with. In most cases, they are a complete stranger prior to the arrangement.

Unlike a known donor — where there is an established history, shared experiences, mutual trust, and time to observe character and behaviour — an unregulated donor is typically someone you:
• Have not known in your everyday life
• Have not built a long-term personal relationship with
• Have no meaningful history or shared community with
• May only know through online messaging or brief communication

Even if conversations have occurred online, or you have met once or twice, this does not create the same depth of relationship as a truly known donor. There has been no long-term familiarity, no observed track record, and no established trust developed over time.

Unregulated donors are usually sourced through:
• Social media platforms
• Online donor groups or forums
• Private advertisements
• Informal networks
Because the arrangement occurs outside a licensed clinic or regulatory framework:
• There is no mandatory medical or genetic screening
• There is no mandatory counselling
• There is no regulated record keeping
• There are no enforced donor limits
• There is no automatic legal protection
• There is no institutional oversight or accountability
The key difference between a known donor and an unregulated donor is the presence — or absence — of a real, established relationship built over time.
A known donor is someone who was already part of your life.
An unregulated donor is someone who enters your life solely for the purpose of donation, without prior shared history, accountability, or established trust.

Why people use this pathway

ARTFam recognises that many people turn to unregulated donation due to:
• Cost barriers
• Long clinic waitlists
• Desire to know, meet the donor
• Geographic isolation
• Exclusion from fertility services
• Desire for autonomy
This pathway is often chosen out of necessity, not preference.

Risks associated with Unregulated Donation

Medical Risks

• No compulsory infectious disease screening
• No verified genetic history
• Risk of undisclosed hereditary conditions
• No central record of donor offspring

Legal Risks

• Donor may later seek parental rights
• Recipient may have limited legal protection
• Agreements may not be enforceable
• No regulated family limits
• Issues may arise with claiming government family support

Emotional and Safety Risks

• Power imbalances
• Boundary violations
• Lack of accountability mechanisms

A Growing and Serious Concern: Sexual Coercion

ARTFam is deeply concerned by the increasing trend of unregulated donors coercing women into having sex to conceive.
This may be presented as:
• “Natural insemination only”
• “Higher success rates”
• “More personal or intimate”
• “The only option available”
This is not acceptable.
👉 Sex is not a requirement for sperm donation.
👉 Pressure, manipulation, or misinformation invalidates consent.

ARTFam has received reports of:

• Grooming behaviour
• Sexual coercion
• Donors escalating boundaries
• Donors changing expectations once pregnancy occurs
This behaviour places women and future children at risk and must be named clearly.

Know the Red Flags

If you are considering or already engaging with an unregulated donor, be alert to the following red flags:

🚩 Insists on sex or “natural insemination only”.

🚩 Dismisses artificial insemination as “unnatural” or less successful.

🚩 Refuses medical or STI screening.

🚩 Avoids written agreements or legal advice.

🚩 Has an unusually high number of donor offspring.

🚩 Changes expectations over time.

🚩 Uses guilt, pressure, or urgency.

🚩 Minimises your concerns or boundaries.

🚩 Frames your discomfort as “overreacting”.

Trust your instincts. Walking away is allowed.

• Independent legal advice
• Medical and genetic screening
• Counselling
• Clear written agreements
• Peer support from trusted communities
• Education around coercion and consent

ARTFam’s Position

ARTFam does not stigmatise individuals who use unregulated donors.
We acknowledge systemic failures that push people into unsafe pathways.
However:
• Lack of regulation does not equal lack of risk
• Consent must be informed, freely given, and ongoing
• No one should ever feel pressured into sex to create their family.
Everyone deserves safety, dignity, and accurate information.
